General Terms and Conditions

ARTICLE 1 – GENERAL PRINCIPLES

These General Terms and Conditions of Sale define the terms and conditions of online sales concluded between SAS Jacques Boyer et fils, with share capital of €1,494,416, registered with the Béziers Trade and Companies Register under number 482 416 468, whose registered office is located at Le Domaine La Croix Belle, 160 Avenue de la Gare (34480) PUISSALICON, and a consumer or non-professional buyer making a purchase via the website lacroixbelle.com.

They are written in French in their original version, which alone is authoritative and prevails over any other version.
These General Terms and Conditions of Sale apply to the exclusion of all other conditions. They are accessible to customers on the website at any time and are systematically submitted to the customer before any order is placed and at the time the order is registered.

Clicking on the button “I accept the general terms and conditions of sale” signifies the customer’s consent to the application of these General Terms and Conditions of Sale.

The customer declares that they have read the following provisions before placing an order for the products.
Consequently, placing an order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

A printed version of the General Terms and Conditions of Sale, as well as any information sent electronically, shall be admissible in any legal proceedings relating to the application of these General Terms and Conditions of Sale in the same manner and under the same conditions as any other written document retained in paper form.

Failure to exercise, at any time, a prerogative recognized by these General Terms and Conditions of Sale, or failure to require the application of any provision of the agreement arising from said conditions, shall in no way be interpreted as a modification of the contract or as an express or tacit waiver of the right to exercise such prerogative in the future, or of the right to require strict performance of the commitments entered into herein.

Given the possible developments of the website, SAS Jacques Boyer et fils reserves the right to adapt or modify these General Terms and Conditions of Sale at any time.
Accordingly, SAS Jacques Boyer et fils invites the customer to consult the General Terms and Conditions of Sale before placing any new order. The General Terms and Conditions of Sale in force at the time of placing the order shall apply to all orders placed from their publication date.

Should any provision of the General Terms and Conditions of Sale be deemed illegal or unenforceable by a court decision, the remaining provisions shall remain in force.

 

 

ARTICLE 2 – REGULATIONS ON THE SALE OF ALCOHOL

Article L3342-1 of the French Public Health Code prohibits the sale of alcohol to minors under the age of eighteen (18). By placing an order, the customer therefore confirms that they are at least eighteen (18) years old on the date of the order.

If the customer resides in a country other than France, they undertake to comply with the laws and regulations of that country and to be of legal age to purchase alcoholic beverages.

Alcohol abuse is dangerous for health. Consume in moderation.

 

 

ARTICLE 3 – PRODUCTS

Each product offered for sale is the subject of a description presenting its essential characteristics in accordance with Article L.111-1 of the French Consumer Code. A descriptive sheet for each product is available on the website lacroixbelle.com.

There may be differences in presentation upon delivery resulting from changes in labeling, packaging, or wrapping (photographs and illustrations) made by the seller; such differences do not affect the content or characteristics of the product.

It is expressly stated that photographs and graphics presented on the website are not contractual and shall not engage the seller’s liability.

Products comply with the requirements of French law in force at the time they are placed on the market.
Products are offered and delivered subject to availability.
Products presented on the website are offered for sale in Metropolitan France only.

In the event of unavailability of the ordered product, SAS Jacques Boyer et fils shall immediately inform the customer and refund the sums paid within fifteen (15) days.
Apart from reimbursement of the price of the unavailable product, SAS Jacques Boyer et fils shall not be liable for any cancellation compensation.

 

 

ARTICLE 4 – ORDER

4-1 Placing an Order

To place an order, the customer must follow the steps below:

  • Access the website address.

  • Follow the instructions on the website, particularly those relating to ordering the product.

  • Complete the order form.

  • Verify the order details and, if necessary, identify and correct any errors.

  • Accept the General Terms and Conditions of Sale by ticking the relevant box and validate the order, the total price, and the all-inclusive price.

  • Follow the instructions of the online payment server to pay the total price.

In the event of prolonged inactivity during the connection, the selection of goods and services chosen prior to this inactivity may no longer be guaranteed. The customer will then be invited to restart the selection process.

The customer will receive electronic confirmation of payment acceptance without delay.
The customer will also receive an electronic order acknowledgment confirming the order (“Order Confirmation”).
The customer will receive electronic confirmation of shipment of the order.

Delivery will take place at the delivery address provided by the customer when placing the order.

By completing the above steps, the customer undertakes to comply with these contractual conditions in accordance with Article 1316-1 of the French Civil Code.

The seller undertakes to honor orders only within the limits of available stock. In the event of unavailability, the seller undertakes to inform the customer and refund the sums paid within fifteen (15) days.

In accordance with Article L.122-1 of the French Consumer Code, the seller reserves the right to refuse any order that is abnormal, placed in bad faith, or for any other legitimate reason.

4-2 Order Modifications

Once confirmed and accepted by the seller under the conditions described above, the order may not be modified.

4-3 Order Cancellation

Once confirmed and accepted by the seller, the order may not be canceled, except in the exercise of the right of withdrawal or in cases of force majeure.

  

 

ARTICLE 5 – PRICE

Orders placed on the website are orders with an obligation to pay.

 

5-1 Sale Price

Products are supplied at the prices in force on the website at the time the order is registered by the seller. Prices are expressed in euros, excluding VAT and including VAT.

Prices take into account any discounts that may be granted by the seller on the website.
These prices are firm and non-revisable during their period of validity, as indicated on the website. Outside this period, the seller reserves the right to modify prices at any time.

Prices do not include processing, shipping, transport, and delivery costs, which are charged in addition under the conditions indicated on the website and calculated before the order is placed.

If the customer requests a faster or more expensive shipping method than standard shipping, the additional delivery costs displayed at the time of order validation shall be borne entirely by the customer.

The payment requested corresponds to the total amount of the purchase, including these costs.

5-2 Payment Methods

Payment is due in full at the time the order is placed, according to the following methods:

  • Credit cards: Visa, MasterCard, bank cards

  • Bank transfer

Payment by credit card is irrevocable, except in the event of fraudulent use of the card.
The full price is payable after order confirmation.

5-3 Payment Security

The website is equipped with an online payment security system enabling the encryption of the customer’s banking data transmitted over the Internet. The seller guarantees the confidentiality of personal data.

 

 

ARTICLE 6 – DELIVERY

6-1 Delivery Methods

The customer selects one of the delivery methods offered on the website when placing the order.

6-2 Delivery Costs

Delivery costs depend on the amount of the order and the delivery method chosen. In all cases, delivery costs are indicated before order validation.

6-3 Delivery Times

Delivery times are available on the website and may vary depending on product availability.
Delivery times are expressed in business days and correspond to average preparation and shipping times.
Delivery times begin from the date of order confirmation by the seller.

The seller undertakes to make every effort to deliver the ordered products within the timeframes indicated. However, these timeframes are indicative.

If the products have not been delivered within fourteen (14) days after the indicative delivery date, for reasons other than force majeure or the customer’s actions, the sale may be canceled at the customer’s request in accordance with Articles L.216-2, L.216-3, and L.241-4 of the French Consumer Code, by registered letter with acknowledgment of receipt sent to:

The sums paid shall then be refunded within fourteen (14) days, excluding any compensation or deduction.

6-4 Delivery Conditions

Delivery is carried out by direct handover of the product to the buyer by the carrier.
Except in special cases or product unavailability, products will be delivered in a single shipment.

The customer must check the condition of the delivered products in the presence of the carrier and refuse the delivery or make reservations if any damage is noted.

The customer has a maximum of three (3) days from delivery to submit any claims for non-conformity or apparent defects by registered letter with acknowledgment of receipt, accompanied by supporting evidence (photos, etc.).

6-5 Product Conformity

If the product does not conform to the order, the customer must notify the seller as soon as possible in order to obtain replacement or cancellation of the sale.

6-6 Delivery and Transfer of Risk

The transfer of risks occurs only when the customer or a designated third party physically takes possession of the products. Products travel at the seller’s risk in accordance with Article L.216-1 of the French Consumer Code.

6-7 Transfer of Ownership

Ownership of the goods is transferred only after full payment of the price, regardless of the delivery date.

 

 

ARTICLE 7 – LEGAL WARRANTY OF CONFORMITY

The customer benefits from the legal warranty of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1648 of the French Civil Code).

The customer:

  • Has two years from delivery to act;

  • May choose repair or replacement, or failing that, price reduction or contract termination under the conditions of Article L.217-12;

  • Is not required to prove the existence of the defect within twenty-four months after delivery.

The customer may also invoke the warranty against hidden defects and choose between cancellation of the sale or a price reduction.

 

 

ARTICLE 8 – LIABILITY

The seller’s liability may only be engaged for damage directly attributable to the seller and causing direct harm to the customer. Indirect damage is excluded.

The seller cannot guarantee uninterrupted access to online services and shall not be liable for network or server failures beyond reasonable control.

 

 

ARTICLE 9 – RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, the consumer has a withdrawal period of fourteen (14) days from receipt of the product.

To exercise this right, the customer must notify the seller within fourteen (14) days and return the products within fourteen (14) days at their own expense.

Refunds will be made within fourteen (14) days from notification of withdrawal.

Products must be returned unused, undamaged, and in their original packaging.

 

 

ARTICLE 10 – PERSONAL DATA PROTECTION

Personal data collected are necessary for order processing and invoicing.
The customer has rights of access, rectification, opposition, portability, and limitation in accordance with applicable regulations.

 

 

ARTICLE 11 – INTELLECTUAL PROPERTY

The customer has no intellectual property rights over the products or website content.
Any reproduction or use is strictly prohibited and may constitute infringement.

 

 

ARTICLE 12 – FORCE MAJEURE

Neither party shall be held liable in the event of force majeure as defined by Article 1218 of the French Civil Code.

 

 

ARTICLE 13 – APPLICABLE LAW – LANGUAGE

These General Terms and Conditions of Sale are governed by French law.
They are written in French. In the event of translation, only the French version shall prevail.

 

 

ARTICLE 14 – DISPUTE RESOLUTION

The customer may resort to mediation in accordance with Article L.612-1 of the French Consumer Code.
Failing amicable resolution, disputes shall be submitted to the competent courts under common law conditions.
